Indian and Canadian citizenship: termination, surrender and OCI
Section 9 says an Indian citizen voluntarily acquiring another citizenship ceases to be Indian upon acquisition. Surrender documents the passport consequence; OCI is foreign-citizen status, not dual citizenship.

Anchor the file to the acquisition date
Canadian law allows dual citizenship, but India applies its own law. Citizenship Act section 9(1) provides that an Indian citizen voluntarily acquiring another citizenship by naturalisation, registration or otherwise ceases to be Indian upon acquisition.
Preserve the Canadian certificate and exact date. Do not keep using an Indian passport while waiting for surrender paperwork; statutory termination and administrative surrender are different events.
Surrender first, then test OCI
Use Passport Seva and the responsible mission for the current surrender process, and retain the cancelled passport and certificate. If names or dates conflict, resolve them before travel or OCI filing.
MEA describes an OCI cardholder as a foreign national, not an Indian citizen. OCI does not grant an Indian passport, voting, constitutional office or unrestricted agricultural-property rights. Test ancestry, spouse, exclusion and document rules; do not infer eligibility from a relative.
Keep four milestones distinct
Use the Canadian passport for Canada as official travel guidance requires and the foreign passport plus OCI or visa for India. Tax, property, pension and banking rules remain separate.

Distinguish termination, renunciation and passport surrender
Section 9 termination after voluntary foreign-citizenship acquisition is not the same statutory act as a section 8 declaration of renunciation. Passport surrender is the administrative process for the Indian passport after citizenship ceased. Name the event that actually occurred on every form.
The Act contains specific consequences for minor children in the renunciation provision, so do not copy them into every section 9 case. For a child with Indian and Canadian connections, identify how each citizenship was acquired and seek individual consular advice.
Build the OCI evidence chain
Connect the applicant to the relevant Indian-origin evidence using birth, marriage and former-passport records. Follow the current mission checklist for originals, copies and attestations; a relative’s OCI approval does not prove the applicant’s eligibility.
After issue, keep foreign-passport and OCI particulars consistent and check the MEA FAQ when details change. Before employment, research, missionary or specially regulated activity, check whether additional permission is required.
