UK Skilled Worker job loss: what to do now

Losing the job does not itself start a guaranteed 60-day grace period. The sponsor reports the event and the Home Office may cancel permission; protect your current status while pursuing a new sponsored role or another route.

Do not invent a clock from the termination date

Sponsors must report when they stop sponsoring a worker. That report and the Home Office’s immigration decision are separate events. Official cancellation guidance says permission may be cancelled and sets out when cancellation to 60 days is considered; it does not promise every worker 60 days beginning on the last day of employment.

If the Home Office cancels permission, read the notice for its effective date and any review or appeal information. Where less than 60 days already remains, job loss does not normally create extra time merely because sponsorship ended. Some circumstances can justify immediate cancellation. Until a decision is made, comply with the permission you actually hold and get regulated advice for disputed facts.

Stabilise the evidence in the first days

Ask the employer to confirm the final working day, reason employment ended, notice or garden-leave position, final salary and whether it has reported the event. Save the contract, Certificate of Sponsorship details, payslips, termination communications and current eVisa evidence outside the employer’s systems.

Check the email, postal address and phone details connected to your Home Office records so a notice reaches you. Record every date without guessing the immigration deadline. If employment facts are contested, obtain employment-law advice separately; an employment dispute does not by itself preserve sponsorship.

Build the replacement application, not just a job search

A new Skilled Worker employer normally needs to be an approved sponsor and assign a new Certificate of Sponsorship. The new job must satisfy the route rules in force for that application. Ask recruiters early whether the employer can sponsor this occupation and when it could issue the certificate.

GOV.UK says a worker changing employer must update the visa, may apply up to three months before the new job’s start date, and must not start the new job until permission is confirmed. Do not travel outside the UK, Ireland, Channel Islands or Isle of Man while the in-country application is pending: GOV.UK warns that doing so withdraws the application.

Test alternatives and protect the whole household

Compare a replacement Skilled Worker application with any genuinely available family, study, talent or other route before filing. Each has its own eligibility and settlement consequences; triage is not permission to switch. Apply while current permission is valid and use the correct route guidance.

Dependants do not automatically receive a new grant because the main applicant updates. GOV.UK says partners and children must apply separately to update their dependant visas, either at the same time or before their current visas expire. Give every family member a separate expiry-and-application row in the plan.

Preserve the record for future settlement questions

Keep exact evidence of employment end, any Home Office notice, the new application date, decision and new job start. Do not assume that a period without sponsored work, or time on another route, counts in the same way toward settlement. Recalculate against the settlement rules for the route ultimately used.

If permission is close to expiry, a notice has arrived, the employer alleges misconduct, or you cannot make a valid application in time, seek advice from a UK-regulated immigration adviser urgently. Avoid unregulated promises to transfer sponsorship or backdate a certificate.
