Renting in Spain: a newcomer’s verification workflow

A safe lease must work as a home, a contract and an administrative address. Verify authority and terms before paying, then document condition and every payment.

Verify before transferring money

Inspect in person or through a trusted representative. Verify the owner or agent’s authority, property identity, rent, term, renewal, break rights, permitted occupants, pets, furnished inventory, repairs and included services. Treat urgency and off-platform payment as risk signals.

Ask whether the documents support padrón registration. Never accept a promise to hide occupancy or use an address where you do not live.

Separate deposit, guarantees and fees

For an ordinary housing tenancy, the Consumer Ministry states that the statutory cash deposit is one month of rent. Additional lawful guarantees are a separate question and must be clear in the contract.

The government has identified transferring property-management and contract-formalisation costs to tenants as prohibited practice under the housing law. Ask for an itemised written demand and receipt rather than paying an unexplained fee.

Create evidence at handover and exit

Photograph every room, defect, appliance and meter with dates. Agree the inventory and key count in writing, report defects promptly and retain rent receipts and repair correspondence.

At exit, give notice through the contract method, document meter readings and condition, return keys with a signed record and provide a traceable account for any refund.
